for Oil & Gas Development

TOWNSHIP OF NEW SEWICKLEY NOTICE OF ADOPTION

The Board of Supervisors of the Township of New Sewickley will hold a public hearing on Monday November 19, 2012 at 7:30 p.m. at Big Knob Grange, 336 Grange Road, Rochester, PA 15074 and thereafter consider adoption of an Ordinance amending Ordinance 162, (Zoning) of the Township Code of Ordinances at a meeting on December 4, 2012 to be held at the New Sewickley Township Municipal Building, 233 Miller Road, Rochester, PA 15074.

An Ordinance amending Ordinance No.162, Zoning (9-17-02) establishing standards for unconventional oil and gas development and operations relating to land use provisions, adding definitions and terms, specifying submittal material and procedures for conditional use approval, outlining review and approval procedures, establishing health, safety and welfare standards, and specifying enforcement proceedings.

ORDINANCE NO. 194

The proposed Ordinance would amend Ordinance No. 162 (Zoning) of the Township Code of Ordinances by adding definitions of terms pertinent to unconventional oil and gas development and operations (hereafter 'Operations;') by permitting Operations by right in the A-1 Agricultural District subject to area and dimensional requirements; by permitting conditionally Operations in the R-1 Suburban Residential District, and C-2 Planning Commercial District, subject to area and dimensional requirements for each district; by permitting Operations, including compressor stations and processing plants, by right in the I Industrial District subject to area and dimensional requirements. A land development application pursuant to the requirements of the Township Subdivision and Land Development Ordinance must be submitted for each unconventional oil and gas operation. Supplemental regulations for Operations require submission of an application detailing, among other things, site access, proof of state approvals, road maintenance and bonding agreements, landscaping plans, building setbacks, fencing, noise levels, emergency response plan and hours of operation. Where Operations are conditionally permitted the Township shall refer the application to the planning commission and conduct a public hearing consistent with the procedures in the Municipalities Planning Code, and providing for repeal of prior inconsistent ordinances and severability.

The amendment to the Township Code of Ordinances will be pending and in effect from the date of first advertisement.
